Acceptance Of Terms

Sawariya Agritech Private Limited (“the Seller”) will supply you (“the Buyer”) with seeds, by way of sale or supply, by these conditions which replace all earlier conditions of the seller, and any adverse conditions, expressed or implied, proposed by the Buyer.

Standards

Seeds sold by the seller (which is the subject of this Contract) are guaranteed to comply at the time of delivery with the National Seed Association of India that are in force and applicable. All information whether contained in the Seller’s catalogue or other descriptive material, or given by the seller’s staff that relates to varieties, varietal characteristics or periods of maturity or fitness for any particular purpose or otherwise relating to the performance of seeds, pesticides and all other farming equipments are given for general guidance only and shall not form part of the Contract nor constitute a representation or warranty by the Seller.
Furthermore, any information given for general guidance may be rendered inapplicable through variation in local or climatic conditions or the manner of storage or treatment after delivery to the Buyer. The Buyer, therefore, should satisfy him/herself that any seeds which he orders are of a variety and performance satisfactory for his requirements and order such seeds at his own risk. For the avoidance of doubt, the Buyer is advised that the Seller’s staff have no authority to give more than general guidance as described above and the Seller disclaims liability for any advice given or opinion expressed by them. Following such advice or acting on such opinions will be entirely buyer’s responsibility and thus, seller will not accountable for your actions.

Dormant Defect

Diseases of plants can be transmitted by the wind, by insects, by animals or by human agencies and may be they are seed-borne or soil-borne. The Seller believes the seed hereby sold to be free from dormant defect, but it is not a condition of the Contract nor does the Seller warrant that any seed sold shall be free from such defect and the Seller will not be responsible in any way for the resultant crop.

Seed Treatment

(a) Whereas the Buyer’s request any treatment whether chemical or otherwise is applied to the seed, the Seller’s liability shall be limited to such treatment being carried out correctly and/or in accordance with the instructions given by the manufacturer of the chemical in question and the Seller accepts no responsibility whatsoever for the effectiveness of such treatment or any damage direct or consequential which may result there from.
(b) Where the seeds have been treated with a liquid or powder to control pests or diseases, or have been fumigated or pelleted, the purity and germination percentages are based on tests made before the treatment.

Reproduction

All kinds of seeds are provided and sold for the production of consumer crops and not for the reproduction of seed. No responsibility whatsoever is accepted for any seed crops produced.

Limitation Of Liablity

(a) The Seller permits that the seed supplied shall be of the species and type specified in the Contract and accepts liability for any damage resulting from any breach of this warranty.
(b) By the established custom of the seed trade, any express or implied conditions, statements or warranties, statutory or otherwise, not stated in these conditions is also excluded. The price of any seeds sold or offered for sale is based upon the foregoing limitations upon the Seller’s liability. The price of such seeds would be much greater if a move extensive liability were required to be undertaken.

Delivery

(a) Each delivery shall be a separate Contract.
(b) The Seller shall not be liable for any delay in the transit of goods howsoever occasioned. Should any goods be rendered unfit for the delivery because of a contingency beyond the Seller’s control, the Contract so far as it relates to those goods shall be assumed to be canceled without responsibility to either party.
(c) In the case of non-delivery of goods, the Seller must be notified within 10 days of the Buyer receiving notification of dispatch or on receipt of an invoice (whichever is the earlier).

Property In Goods And Risk

(a) All the delivered goods are seller property until entire amount paid in full.
(b) Risk moves to the Buyer on delivery of the goods.

Terms Of Payment

All goods are sold for pre- payment, no COD or any other means will be taken care of.

Arbitration

Any dispute arising out of these Terms and Conditions of Sale shall be referred to a single arbitrator to be agreed by the Seller and Buyer or failing agreement to be nominated by the National Seed Association of India and Indian Seed Sector.

We try to maintain proper stock counts on our website but from time-to-time, there may be a stock discrepancy and we will not be able to fulfill all your items at the time of purchase. 2. Shipping Costs

3. Returns

3.1 Return Due To Change Of Mind

Sawariya Kisan Bazaar will happily accept returns due to change of mind as long as a request to return is received by us within 10 days of receipt of item and are returned to us in the original packaging, unused and resellable condition.
Return shipping will be paid at the customer's expense and will be required to arrange their shipping.
Once returns are received and accepted, your liable refunds will be processed to store credit for a future purchase. We will notify you once this has been completed through email.

3.2 Warranty Returns

Sawariya Kisan Bazaar will happily honor any valid warranty claims, provided a claim is submitted within 90 days of receipt of items.
Customers will be required to pre-pay the return shipping, however, we will reimburse you upon a successful warranty claim.
Upon return receipt of items for a warranty claim, you can expect Sawariya Kisan Bazaar to process your warranty claim within 7 days.
Once the warranty claim is approved, you will get the choice of:

(b) a refund in-store credit

4. Delivery Terms

4.1 Transit Time Domestically

In general, domestic shipments are in transit for 2 - 7 days.

4.2 Transit time Internationally

Generally, orders shipped internationally are in transit for 4 - 22 days. This varies considerably depending on the courier you have selected. We can offer a more specific estimate when you are choosing your courier at the checkout.

4.3 Change Of Delivery Address

Orders placed before 04 PM (GMT+5:30) will be dispatched the same day, otherwise, within the next business day.
Our warehouse operates from Monday to Saturday during standard business hours, except on national holidays at that time the warehouse will be closed. In these instances, we take actions to ensure shipment delays will be kept to a minimum delay.
